Welcome to Toffer. Toffer is a mobile application that allows customers to walk into any participating restaurant, browse the menu, place an order, and pay securely — all from their phone. Toffer also operates a universal loyalty points program that rewards customers on every order. These Terms of Service (the "Terms") govern your access to and use of the Toffer mobile application and related services. By downloading, installing, or using Toffer, you agree to be bound by these Terms.
Toffer is operated by Toffer Inc., a company incorporated in Canada. Our services are available to users in Canada.
By creating an account or using any part of the Toffer app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.
You must be at least 13 years old to create a Toffer account. Users under 18 must have consent from a parent or legal guardian. By using Toffer, you represent that you meet these age requirements.
The Toffer app is a free-to-download mobile application available on iOS and Android. It enables customers to:
Walk into a participating Toffer restaurant and have the menu open automatically on their phone
Browse the full menu, customize items, and place orders directly from their device
Pay securely within the app at the menu price with no added service fees or hidden charges
Earn loyalty points automatically on every order and redeem them at any Toffer restaurant in Canada
Toffer is available at participating restaurant locations across Canada. The list of participating restaurants may change at any time. We strive to provide continuous app availability but may experience occasional downtime for maintenance or updates. We will make reasonable efforts to notify users of planned outages in advance.
To use Toffer, you must create an account by providing your name, email address, and phone number. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must immediately notify us at info@toffer.ca if you suspect any unauthorized use of your account or any security breach. We are not liable for losses resulting from your failure to protect your account credentials.
You agree to provide accurate and complete information when creating your account and to keep it up to date. We reserve the right to suspend accounts that contain false or misleading information.
The Toffer app is free to download and use. You pay only for the food you order — at the exact menu price displayed, with no service fees, no markups, and no hidden charges. Payment is processed securely within the app at the time you confirm your order.
All payments are processed through a secure third-party payment provider. By placing an order, you authorize Toffer to charge your selected payment method for the total amount shown at checkout. Toffer does not store your full payment card details on its servers.
Once an order is placed and accepted by the restaurant, it cannot be cancelled through the app. If you experience an issue with your order (incorrect items, missing items, or food quality concerns), please raise the issue directly with the restaurant staff at the time of your visit. For unresolved issues, contact us at info@toffer.ca. Refunds are handled on a case-by-case basis at our discretion in cooperation with the restaurant partner.
Toffer uses your device's location to automatically detect when you are inside a participating restaurant and open the correct menu. This is core to how the app works. By using Toffer, you consent to the app accessing your device's location while the app is in use.
You may disable location access at any time in your device settings, but doing so will prevent the automatic restaurant detection feature from working. Toffer does not share your precise location data with third parties or use it for advertising purposes. For full details on how we handle location data, please refer to our Privacy Policy.
Toffer operates a universal loyalty points program available to all registered customers. Points are earned automatically at checkout at a rate of 5 points per $1 CAD spent at any participating Toffer restaurant. Points can be redeemed at any Toffer restaurant location across Canada — points earned at one restaurant can be used at any other restaurant in the Toffer network.
Loyalty points have a lifetime of 6 months from the date they are earned. Points that are not redeemed within this 6-month period will expire and be permanently removed from your account. Toffer will send a push notification to your registered device at least 14 days before any points are set to expire, giving you an opportunity to use them before they are lost. It is your responsibility to ensure notifications are enabled on your device to receive these alerts.
Points have no cash value and cannot be transferred, sold, or exchanged for cash. Toffer reserves the right to modify the points earning rate, redemption value, or expiry policy at any time with reasonable notice to users. In the event of account termination, all accumulated points will be forfeited.
Toffer is a technology platform that connects customers with participating restaurant partners. The restaurants listed on the Toffer app are independent businesses. Toffer is not responsible for the quality, safety, preparation, or accuracy of any food or beverages ordered through the app. All food and beverage orders are fulfilled entirely by the restaurant.
If you have a concern about your food order, allergen information, or restaurant service, please speak directly with the restaurant. Toffer does not guarantee the availability of any specific menu item, as menus are managed by each restaurant and may change without notice.
Subject to these Terms, Toffer grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the Toffer mobile application on your personal device solely for your own personal, non-commercial use. You may not:
Copy, modify, or distribute the app or any part of it
Reverse engineer, decompile, or attempt to extract the source code
Use the app to build a competing product or service
Remove any copyright, trademark, or other proprietary notices
This licence is automatically revoked if you violate any of these Terms.
Your use of Toffer is governed by our Privacy Policy. We collect and process data necessary to provide our services, including your account information, order history, location data, and loyalty points activity. You retain ownership of your personal data, and we will not sell it to third parties.
We implement industry-standard security measures to protect your data, including encryption in transit and at rest, secure authentication, and regular security reviews. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
You may request deletion of your account and personal data at any time by contacting us at info@toffer.ca. Upon deletion, your order history and loyalty points will be permanently removed. Some data may be retained as required by applicable law.
You agree to use Toffer only for lawful purposes and in accordance with these Terms. You may not use the app to:
Violate any applicable laws or regulations
Engage in fraudulent activity, including submitting false orders or attempting to manipulate the loyalty points system
Transmit malicious code, viruses, or any harmful content
Attempt to gain unauthorized access to our systems or other users' accounts
Use automated tools to interact with the app in ways not intended for regular users
All content, features, and functionality of Toffer, including but not limited to the software, text, graphics, logos, and design, are owned by Toffer Inc. and are protected by copyright, trademark, and other applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Toffer integrates with third-party services including payment processors and the Apple App Store and Google Play Store for app distribution. We are not responsible for the availability, functionality, or terms of service of these third-party platforms. Any use of third-party services is subject to their own terms and privacy policies.
To the maximum extent permitted by applicable Canadian law, Toffer Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to issues with food orders, payment processing errors, or loss of loyalty points. Our total liability to you for any claim arising out of these Terms shall not exceed the total amount you paid through the Toffer app in the 30 days preceding the claim.
The Toffer app is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free from viruses or other harmful components. You use the app at your own risk.
We reserve the right to modify these Terms at any time. We will notify you of material changes via push notification or email. Your continued use of Toffer after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the app.
We may suspend or terminate your access to Toffer at any time, with or without notice, for violation of these Terms or any other reason we deem necessary. Upon termination, your right to use the app will immediately cease and any accumulated loyalty points will be forfeited.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of Toffer shall be resolved exclusively in the courts of Ontario, Canada.
