Welcome to Toffer, a comprehensive restaurant management system designed to streamline your restaurant operations. These Terms of Service (the "Terms") govern your access to and use of Toffer's software, services, and platforms. By accessing or using Toffer, you agree to be bound by these Terms.
Toffer provides restaurant management solutions including Point of Sale (POS) systems, Kitchen Display Systems (KDS), inventory management, table management, customer management, VIP Club features, analytics and reporting tools, and mobile applications for both restaurant owners and customers.
By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.
These Terms apply to all users of Toffer, including restaurant owners, managers, staff members, and end customers who use the Toffer ordering application. You must be at least 18 years old to use our services or have permission from a parent or guardian.
Toffer offers a cloud-based restaurant management platform accessible via web and mobile applications (iOS and Android). Our services are divided into three main subscription tiers: Essential, Pro, and Elite, each offering different features and capabilities tailored to various restaurant sizes and needs.
Essential Plan: Designed for small restaurants, food trucks, and cafes with basic POS, menu management, table management, and simplified reporting features.
Pro Plan: Includes multi-user access, Kitchen Display System (KDS), inventory management, advanced analytics, and VIP Club features for growing restaurants.
Elite Plan: Comprehensive solution for large establishments with multi-station kitchen management, multi-location support, and advanced performance analytics.
We strive to provide continuous service availability. However, Toffer may experience occasional downtime for maintenance, updates, or unforeseen technical issues. We will make reasonable efforts to notify you of planned maintenance in advance.
To use Toffer services, you must create an account by providing accurate and complete information including your restaurant name, address, contact details, and payment information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials. You agree to use strong passwords and enable all available security features.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate accounts that contain false or misleading information.
Toffer offers multiple subscription plans with monthly billing cycles. The Essential Plan is currently offered free for a limited time (regular price $19.99/month), the Pro Plan is $29.99/month, and the Elite Plan is $59.99/month. All prices are in USD unless otherwise specified.
Subscription fees are billed monthly in advance. You authorize us to charge your designated payment method for all fees incurred. If automatic billing fails, we will attempt to notify you and may suspend your service until payment is received.
The Essential Plan is currently free for a limited time. We reserve the right to end this promotional period at any time with 30 days notice to existing users. After the promotional period ends, standard pricing will apply unless you cancel your subscription.
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. We do not offer refunds for partial months of service. Upon cancellation, you will retain access to your data for 30 days, after which it may be permanently deleted.
Different subscription plans have different feature limitations. Push notifications are limited to 2 times per month for Essential Plan users and 5 times per month for Pro and Elite Plan users. Additional usage beyond these limits may require an upgrade to a higher tier plan.
Your use of Toffer is also governed by our Privacy Policy. We collect and process data necessary to provide our services, including restaurant information, menu data, customer information, order history, and analytics. You retain ownership of your data, and we will not sell your data to third parties.
We implement industry-standard security measures to protect your data, including encryption, secure authentication, and regular security audits. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
We perform regular backups of your data. You may export your data at any time through the platform's export features. Upon account termination, you have 30 days to export your data before it is permanently deleted.
You agree to use Toffer only for lawful purposes and in accordance with these Terms. You may not use our services to:
Violate any applicable laws or regulations
Infringe upon the rights of others or engage in fraudulent activities
Transmit malicious code, viruses, or any harmful content
Attempt to gain unauthorized access to our systems or other users' accounts
Reverse engineer, decompile, or attempt to extract the source code of our software
All content, features, and functionality of Toffer, including but not limited to software, text, graphics, logos, and design, are owned by Toffer and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our services without our express written permission.
Toffer may integrate with third-party services or hardware (such as receipt printers and kitchen display monitors). We are not responsible for the availability, functionality, or terms of service of third-party products. Any use of third-party services is at your own risk.
To the maximum extent permitted by law, Toffer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.
Toffer services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure. You use our services at your own risk.
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the platform. Your continued use of Toffer after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our services.
We may suspend or terminate your access to Toffer at any time, with or without notice, for violation of these Terms, non-payment, or any other reason we deem necessary. Upon termination, your right to use the services will immediately cease, and you must cease all use of our platform.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Toffer operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Toffer shall be resolved in the courts of that jurisdiction.
